1. Who we are

Elliot Sings is operated by Jim Ressler ("we", "us", "our"). By using this site or purchasing a song, you ("you") agree to these Terms & Conditions.

2. Acceptance

Your continued use of the site or purchase of a song constitutes acceptance of these terms. If you do not agree, please do not use the service.

3. The service

We create original, personalized songs based on information you provide. Each song is crafted individually and delivered as an audio file. Turnaround times are estimates, not guarantees.

4. Acceptable use

You agree not to misuse the service, including: unlawful use, fraud, spam, infringing third-party intellectual property, submitting content you don't have rights to, harassing any person, or interfering with the security of the site (malware, probing, scraping, unauthorized access).

5. Intellectual property

All site content, branding, and the underlying compositions remain our property. On delivery of a completed song, you receive a perpetual, non-exclusive license to use the song for personal, non-commercial purposes. Commercial use, resale, or redistribution requires our written permission.

6. Your content

You grant us a limited license to use the names, stories, photos, and other content you submit solely to create and deliver your song. You confirm you have the right to share that content with us.

7. Service level

We aim to provide a reliable service but do not guarantee uninterrupted or error-free access. All implied warranties are disclaimed to the fullest extent permitted by law.

8. Payments, billing, refunds & cancellations

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

9. Suspension & termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated/serious policy violations.

10. Liability

To the fullest extent permitted by law, our aggregate liability for any claim relating to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms excludes liability that cannot be excluded by law.

11. Governing law

These terms are governed by the laws of the United States and the state in which we reside. Disputes will be resolved in the courts of that jurisdiction.
